LAISE, Luciano Damián. Freedom of Conscience and Conscientious Objection of Private Health Clinics: Conceptual Grounds for its Constitutional Interpretation. Cuest. Const. [online]. 2019, n.40, pp.317-352. Epub 20-Mar-2020. ISSN 1405-9193. https://doi.org/10.22201/iij.24484881e.2019.40.13236.
This article aims at highlighting the consequences of the conceptual connection between conscience, freedom of conscience and conscientious objection. In order to do that, firstly, it will be necessary to reconstruct the meaning of those three concepts. That reconstruction will offer a concept of conscientious objections not mainly based on the principle of no harm to third parties, but on available choices in the case. Then, I will apply reasonableness test for interpreting the scope of the right of conscientious objection and to determine if it is desirable to admit an institutional conscientious objection for private health clinics.
