Abstract

MORALES-AGUILERA, Paulina. Habermas and human rights: possibilities and restrictions of a reflection. Convergencia [online]. 2014, vol.21, n.65, pp.13-37. ISSN 2448-5799.

This article provides a reflection on human rights based on Jürgen Habermas' discursive approach. Nevertheless, it is know that this subject is framed in a higher discussion about democracy and State of Legitimacy, especially emphasizing three areas. Firstly, the so called «system of rights», its structure and fundamental contents; secondly, the universality of human rights; and finally, a set of reflections about the difficulties posed by the conceptualization of human rights the author develops.
