The aim of this paper is to analyses one of the most relevant issues in the legal and religious fields: the strained relations between state, politics, and religion in the work The Emergence of the State as a Process of Secularization by the German jurist Ernst-Wolfgang Böckenförde. That work gave rise to his famous “Theorem”, which sets forth that the modern liberal state lives on preconditions it cannot guarantee. The propositions that shape the Theorem have been given many different interpretations. In this work, we will only analyze the most relevant conceptions that we consider as the foundations of the democratic and constitutional state. In our opinion, the ideas that the German jurist expresses in this book provide the necessary tools to examine essential aspects of political philosophy and philosophy of law. With this in mind, we seek to offer some key insights that help read the theorem from a philosophical perspective.
