According to the doctrine and jurisprudence, criminal responsability for negligence is based on the infringement of a duty of care. However, negligence and the duty of care present a series of particularities that need to be analyzed. This article aims, on the one hand, to examine negligence as an extraordinary form of imputation and, on the other hand, to defend the use of the concept of concern (Obliegenheit) as necessary to explain this form of responsability.
