This article examines the transition from soft law to hard law through the lens of the Mexican legal system. Specifically, it investigates how judicial soft law instruments — which do not satisfy the requirements of formal sources of law— acquire normative force when incorporated into judicial reasoning that could set precedent. The analysis explains that the instrumental use of judicial soft law effects significant transformations in the interaction between informal and formal legal sources, thereby reshaping contemporary legal practice. These findings rise fundamental questions regarding legal theory and the content of core jurisprudential concepts.
