Abstract

In this essay, I will assert that “tesis aisladas” and “tesis de jurisprudencia” transcend mere informational documents and hold normative relevance within the Mexican legal system. To substantiate this claim, I will employ various parameters. Firstly, jurisdictional bodies possess the authority to generate these “tesis.” Secondly, legal provisions mandate the application of “tesis de jurisprudencia.” Additionally, case law dictates that “tesis aisladas” carry persuasive weight. Thirdly, there exists a structured process for the discussion and endorsement of these “tesis” as independent documents from precedents. Fourthly, the voting patterns observed in numerous “tesis” underscore their substantive nature. Finally, these “tesis” serve as foundational support for legal resolutions and even have the potential to overturn jurisdictional decisions. The normative relevance of these “tesis” engenders both advantages and challenges warranting further examination.
