The purpose of this study is to carry out a legal analysis that highlights the importance of establishing a cinematheque in Peru and its relationship with human rights. Through a legal and cultural approach, focusing on the right of access to culture, the right to cultural heritage, the right to identity and the right to memory. It is concluded that the Peruvian Cinematheque would not only preserve the cinematographic heritage, but would also facilitate the exercise of these rights and contribute to the strengthening of cultural identity and historical memory. This study highlights the relevance of audiovisual preservation in the current context, considering the threat of loss of audiovisual and cinematographic records in Peru due to the lack of adequate measures for their conservation. Its originality lies in its interdisciplinary approach that links human rights with the preservation of audiovisual heritage. Therefore, the Peruvian Cinematheque, as a cultural entity, emerges as an ideal space to materialize these rights and enrich the cultural identity and historical memory of the country.
