GARCIA RIVERA, Enoc Alejandro e ESPINOZA TENORIO, Alejandro. Culture as a Human Right and its Implications. Bol. Mex. Der. Comp. [online]. 2023, vol.56, n.166, pp.49-82. Epub 30-Jul-2024. ISSN 2448-4873. https://doi.org/10.22201/iij.24484873e.2023.166.18906.
Culture as an integral part of humanity produces elements and dynamics that act in correspondence with actions that induce and shape individual and collective skills that allow the production, accumulation and transmission of experiences and generational knowledge linked to the different environments and social structures in which they its members develop. Learning and skills that in turn promote the necessary capacities to decipher and adapt to any habitat on the face of the earth; to organize community regardless of the scale or size of the human group; and, above all, to understand and adopt the role that each one has in the world with respect to themselves. Qualities that provide immeasurable value for humanity and for which it was deemed necessary to cover it under the character of a fundamental right to preserve it and protect her. Based on the above, the present academic work intends to approach the analysis of the constitutional implications that are established due to the rise of culture as a human right in order to contribute to its notion and legal discussion.
