The implementation of constitutional legitimacy for credibility and confidence in Latin American democratic systems is developed through legal and institutional transparency. Its consolidation as a constitutional right prevents weakening of other related basic rights, such as participation and freedom of information. The analysis of regulatory deficiencies of transparency from a territorial prism, subjective, objective and in relation to the limits poses legal challenges to its implementation in the Latin American context.
