Abstract

There have always been different interpretations regarding positivism's main tenets. As the author of this essay explains, legal positivism is not a homogenous stream, and it is of little use to support or criticize positivism in general, without pointing out the specific thesis subject to defence or scrutiny (this is valid in relation to other isms in legal philosophy). Today, positivism shows this difference in points of view with an internal debate between exclusive and inclusive positivists. This article has as its main goal to explain Raz' arguments concerning exclusive positivism, in order to make a contribution to the understanding of the line of argumentation that leads to this conception. In this way, the essay helps us to understand the differences between Raz' perspective and other positivisms.
