The 2008 constitutional reform to the Mexican criminal system has involved important paradigmatic shifts in the contribution and assessment of evidence. The expert opinion, while surrounded with the prestige of science, is presumed to be the most reliable to create the judicial truth that is sought in a trial. The question is whether the frequency of expert evidence is truly growing exponentially. For this, we have constructed a corpus of the Federal Courts’ judicial sentences during the oral trial stage, from 2016 to 2021, that allows us to understand the evidence tendencies that have been incorporated to trials. This kind of empirical research is not frequent in the legal field, but we consider its promotion and analysis is relevant, for it reveals the low incidence of expert evidence on trials and the predominance of testimonials, reminiscent of the previous criminal system.
