The Public Broker is an auxiliary of commerce and in his attributions he has to be a Public Fededator, establishing article 6 section V of the Federal Law of Public Brokerage, which can intervene in all commercial acts and events except in the case of real estate, however, those acts may involve this type of property. The objective of this study is to determine if there is a contradiction between the article referred to in the upper paragraph and the constitutional context, the guiding principles of commercial matters, and secondary commercial legislation, which is analyzed through a review of the literature, the applicable laws and jurisprudence. It was concluded that contradiction exists; in addition to, being a violation of Human Rights, it is therefore proposed to eliminate the phrase “except in the case of real estate”, contained in section V of article 6 of the LFCP.
