This article critically addresses the convenience of creating new human neurorights to address the use of neuroprediction and lie detection technologies in penal systems. On this point, it is argued that neurorights could be conceptually problematic, or offer less protection than the one that can be extended by better interpretations of current fundamental rights and the constitutional principles of criminal law. The article ends by formulating a new critical proposal to limit neurotechnolo gy and propose the abolition of criminal law; we have called this proposal "penal neuroabolitionism".
