The disappearance of people in Mexico is one of our most serious security and justice problems. The law available today is consistent with international commandments; however, its interpretation and application show confusion, mainly in the disappearance committed by individuals, in the concealment concept dimensions. That gives rise to the erroneous recording of its incidence and its justiciability. In addition, the institutional and social structures of corruption and impunity that foster them and make them systematic are not investigated, so the active impunity system subsists. In this research, we got a corpus of sentences handed down on the crimes of forced disappearance and disappearance committed by individuals, from which it was possible to conclude the low number of convictions achieved, the difficulty to consult them, the confusion in the crimes, the legal uncertainty that this represents, the prevalence of the use of testimonial evidence to prove the facts, the absence of a robust investigation methodology based on science and the lack of effectiveness of criminal investigations to reduce the disappearance of people.
