^les^aLa autora presenta un estudio sobre el papel que ha desempeñado el Tribunal Constitucional italiano ante el problema de la legitimación de la justicia constitucional. Comienza describiendo el desarrollo de la tensión que se ha dado entre la justicia constitucional y la democracia. Posteriormente, analiza el sistema italiano de justicia constitucional como un sistema concentrado en el que las decisiones del tribunal producen efectos erga omnes. Después explica cómo es que el problema de la legitimidad ha incidido en la composición y actuación del tribunal constitucional. En este sentido, analiza las transformaciones que ha sufrido el sistema italiano en lo que se refiere a los efectos de las sentencias y la participación de los jueces comunes en la justicia constitucional.^len^aThe author puts forward a study on the role performed by the Italian Constitutional Court vis a vis the problem of legitimacy of constitutional justice. She starts with a description of the tension that has been developing between constitutional justice and democracy in Italy. Later, she analyzes the Italian system of constitutional justice, explaining that it is a concentrated system in which the decisions of the Court produce erga omnes effects. Moreover, she explains how it is that the problem of legitimacy has influenced on the formation and functioning of the Constitutional Court. In this sense, she examines the transformations that the Italian system has experienced, concerning the effects of the Court's decisions and the participation of ordinary judges in the system of constitutional justice.
