^les^aEl artículo tiene por objeto analizar cuáles son los retos y las perspectivas del derecho sindical ante la globalización. En primer lugar, el autor expone el origen y desarrollo del derecho sindical. Asimismo, se refiere a las diferentes definiciones de derecho sindical y a las instituciones que lo integran, basándose en la teoría triangular de Mario de la Cueva, que incluye el derecho a la sindicalización, la huelga y el contrato colectivo de trabajo. Por otra parte, explica en qué consisten las tendencias flexibilizadoras del derecho sindical, surgidas en el contexto de la globalización. Posteriormente, trata de determinar en el nuevo contexto cuál es la naturaleza jurídica del derecho sindical, para finalmente analizar el papel de esta disciplina en la actualidad.^len^aThe goal of this essay is to study the challenges and perspectives of trade-union's legal regime, in face of globalization. In the first place, the author explains the origins and development of "trade-unions law", referring to the different definitions of this concept and to its most important institutions, such as the right to form these organizations, the right to strike and collective bargaining. Secondly, he refers to the trend toward the "flexibilization" of the labor market (and of trade-unions legal regime) that has emerged in the context of globalization. Moreover, he tries to determine which is the legal nature of "trade-unions law", and discusses the role of this area of the law today.
