Tomando como punto de partida los argumentos recientes de Cécile Fabre (2016) contra el uso de este tipo de leyes o criterios de inadmisibilidad por parte de Joseph Carens (2013), descarto una serie de posibles objeciones contra este criterio y ofrezco una crítica normativa distinta y sustantiva contra esta forma de inadmisibilidad migratoria. Esta crítica se funda en el principio de igualdad en la base de cualquier teoría política plausible que, consecuentemente, debe ser parte de una comprensión adecuada de la pena dentro de una comunidad política. De lo anterior concluyo que el criterio de inadmisibilidad penal es injustificable dentro de una comunidad política que aspira a respetar el igual estatus moral de todos los individuos.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract Are laws that forbid the entrance of foreigners in a state on grounds of their criminal record morally justifiable? Taking as a starting point Cecile Fabre&#8217;s arguments (2016) against Joseph Caren&#8217;s use of these laws or criteria of inadmissibility (2013), I consider a series of plausible arguments against these criteria to ultimately reject each of them. Instead, I offer a different and substantive normative critique against this criterion of penal inadmissibility based on the principle of equality, pivotal to any plausible political theory and, thus, central to an adequate conception of punishment within the political community. Ultimately, I deem penal inadmissibility unjustifiable within a political community that aspires to respect each individual&#8217;s equal moral status.]]></p></abstract>
