A partir de ese reconocimiento, las modificaciones legales reforzaron los mecanismos de acciones afirmativas a favor de género. Al mismo tiempo, se abrió un importante espacio para la interpretación constitucional de los alcances e implicaciones de dicho principio. El presente trabajo revisa la postura e interpretación llevadas a cabo por los dos órganos de control de constitucionalidad en la materia electoral, la Suprema Corte y el Tribunal Electoral, respecto del principio de paridad de género en la asignación de escaños de representación proporcional. Las conclusiones de que las modificaciones al orden de candidatos en las listas de mejores perdedores van más allá de lo previsto por la Constitución, resultan en una violación al principio democrático de respeto de la voluntad del electorado, así como trastocan el objetivo de la acción afirmativa.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract: The 2014 constitutional reform included among the principles of gender parity; after that, subsequent electoral law amendments strengthened the quota. Including gender parity as a constitutional principle opened a new debate and created a need for legal interpretation. This paper reviews the position and interpretation undertaken by the two bodies in charge of constitutional review in electoral matters, the Supreme Court and the Electoral Tribunal, in relation to the principle of gender equality in the allocation of PR seats. The conclusions show that changes in the order of candidates on &#8220;best losers&#8221; lists go beyond the constitutional provisions, result in a violation of the principle of democratic election and in disrespect of the will of the people, as well as disrupt the objective of affirmative actions.]]></p></abstract>
