Se centrará en una objeción puntual contra ellos, la que los sospecha de proveer a la mayoría un medio para tiranizar a las minorías, aquí traducida en términos de tensión entre el principio de soberanía popular y el sistema de derechos, pues exacerba la soberanía popular en detrimento de derechos humanos, en el caso, derechos de las minorías. Contra esta objeción sostendré que si (&#945;) la gramática institucional del referéndum garantiza una estructura básica de justicia y (&#946;) él es utilizado en un contexto democrático, entonces este armoniza el principio de soberanía popular y el sistema de derechos, y por tanto, no representa un medio para tiranizar a las minorías, i.e. goza de legitimidad democrática en lo que concierne al aspecto aquí considerado. En el caso de que alguna de aquellas condiciones falten, el referéndum resulta ilegítimo en términos democráticos. Del primer tipo de referéndum se dirá que pertence a la forma pura, mientras que, del segundo, se dirá que reviste la forma corrupta. A lo largo del artículo se especificará en qué consisten las condiciones (&#945;) y (&#946;).]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract This article aims at providing a normative elucidation of the democratic legitimacy of referenda. It will focus on one specific objection against them, namely that they provide a means through which the majority may tyrannize minorities -here translated in terms of a tension between the principle of popular sovereignty and the system of rights- given that it exacerbates popular sovereignty to the detriment of minorities&#8217; rights. Against that objection, I will hold that, if (&#945;) the institutional grammar of the referendum ensures a basic structure of justice, and (&#946;) it is used in a democratic context, then it harmonizes the principle of popular sovereignty and the system of rights, and therefore, it does not constitute a means through which the majority may tyrannize minorities, i.e. it enjoys democratic legitimacy respecting the aspect here considered. If the referendum lacks any of these conditions, it is illegitimate in democratic terms. The former is a pure form of referendum, whereas the latter is a corrupt form of it. Throughout the paper, I will specify what the conditions (&#945;) and (&#946;) consist in.]]></p></abstract>
