La gobernanza socioeconómica y normativa actual sobre el presente asunto es insuficiente en vista de los conflictos surgidos e indicios de disputas futuras. En aras de evitar, reducir, atenuar y/o dirimir controversias de este tipo, y preservar tanto las relaciones internacionales como las poblaciones de peces, se propone establecer un nuevo instrumento de pesca holístico bajo la CNUDM. El instrumento debería establecer los principios básicos que rigen la ordenación de la migración de peces inducida por el cambio climático desde una perspectiva socioeconómica y jurídica. Asimismo, cubriría tanto las zonas económicas exclusivas como alta mar. En particular, debería fomentar una integración mayor e inmediata de avances científicos relevantes en la política pesquera; mayor flexibilidad en el reconocimiento e intercambio de derechos de pesca; un enfoque combinado ascendente y descendente de la ordenación pesquera; la creación de un comité mundial de supervisión (compuesto por miembros de la FAO, el ICES, la OCDE y, cuando se trata -indirectamente- de subsidios, la OMC, y el recurso a ITLOS y al arbitraje internacional para resolver disputas. El último concepto principal (cambios en las subvenciones a la industria pesquera para abordar la sobrecapacidad y la sobrepesca) se está abordando actualmente a nivel de la OMC a través de un proyecto de texto y debería tenerse en cuenta en el nuevo instrumento.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract Due to climate change, a significant migration of fish is taking place in respect of which current legal and economic norms and instruments are ill equipped to manage. Various disputes in the past, and a list of factors indicating that there shall be more such disputes in the future, underscore the inadequacy of socio-economic governance and legal norms on this issue. To avoid, reduce, mitigate and/or resolve future disputes of this nature, and thus preserve international relations as much as the relevant fish stocks, a new international, holistic fisheries instrument, adopted under UNCLOS, is needed. This instrument should set out basic principles governing the management of climate change-induced fish migration from a socio-economic and legal perspective. The new instrument would cover, to a varying degree, both exclusive economic zones and the high seas. In particular, it should provide for increased and more immediate use of scientific findings in policy making; greater flexibility in the recognition and exchange of rights to fish; a combined bottom-up and top-down approach to fisheries management; and recourse to an international supervisory committee (composed of members from the FAO, ICES, the OECD and, where subsidies are [indirectly] involved, the WTO), ITLOS and to international arbitration to resolve disputes. The final main concept (changes to fishing industry subsidies to address overcapacity and overfishing) is currently being addressed at WTO level and should be taken into account in the new instrument.]]></p></abstract>
<abstract abstract-type="short" xml:lang="fr"><p><![CDATA[Résumé En raison du changement climatique, il existe une migration importante des poissons pour laquelle les normes et outils juridiques et économiques actuels sont inadaptés. Divers différends dans le passé, et une liste de facteurs indiquant qu&#8217;il y aura une augmentation de tels différends à l&#8217;avenir, soulignent l&#8217;insuffisance de la gouvernance socio-économique et des normes juridiques sur cette question. Pour éviter, réduire, atténuer et/ou résoudre de futurs différends de cette nature, et ainsi préserver les relations internationales autant que les stocks halieutiques concernés, un nouvel instrument international holistique de pêche, adopté dans le cadre de la CNUDM, est nécessaire. Cet instrument devrait énoncer les principes de base régissant la gestion de la migration des poissons induite par le changement climatique d&#8217;un point de vue socio-économique et juridique. Le nouvel instrument couvrirait, à des degrés divers, à la fois les zones économiques exclusives et la haute mer. En particulier, il devrait prévoir une utilisation accrue et plus immédiate des découvertes scientifiques dans l&#8217;élaboration des politiques; une plus grande flexibilité dans la reconnaissance et l&#8217;échange des droits de pêche; une approche combinée ascendante et descendante de la gestion de la pêche; et le recours à un comité de surveillance international (composé de membres de la FAO, du CIEM, de l&#8217;OCDE et, lorsque des subventions sont -indirectement- impliquées, de l&#8217;OMC), du TIDM et à l&#8217;arbitrage international pour régler les différends. Le dernier concept principal (les modifications des subventions à l&#8217;industrie de la pêche pour lutter contre la surcapacité et la surpêche) est actuellement traité au niveau de l&#8217;OMC et devrait être pris en compte dans le nouvel instrument.]]></p></abstract>
