El texto muestra, en primer lugar, que la compasión &#8212;como fuerza central que mueve al humanitarismo sexual a &#8220;rescatar&#8221; a las víctimas de explotación sexual&#8212; no es necesariamente, como sostienen algunos, una fuerza que silencia a quien la recibe. Las diferencias de contexto y de dinámicas políticas, pueden determinar que, en ciertas ocasiones, la compasión efectivamente silencie, mientras que en otras puede dar lugar a dinámicas sociales verdaderamente emancipatorias. El artículo propone, así, que, en cada caso concreto en que aparece la compasión como fuerza movilizadora, se haga un análisis pragmático de los costos y beneficios de este uso. En segundo lugar, el ensayo traslada el marco conceptual anterior a la discusión constitucional sobre la prostitución y el trabajo sexual en Colombia y muestra cómo ésta ocurre en un terreno dominado por un humanitarismo sexual compasivo que ha determinado la &#8220;sentimentalización&#8221; de los valores de dignidad, autonomía e igualdad. Un análisis pragmático de la jurisprudencia de la Corte Constitucional colombiana sobre prostitución, trabajo sexual y tráfico de personas permite concluir, al menos provisionalmente, que la señalada sentimentalización constitucional sustenta, de manera simultánea, el proyecto político de la regulación del trabajo sexual y el de la abolición de la prostitución.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract  The essay aims at contextualizing the current debate on the abolition of prostitution or the regulation of sexual work in the dynamics of a highly sentimentalized sexual humanitarianism. The article first shows that compassion &#8212;as the driving political force that moves sexual humanitarianism to &#8220;rescuing&#8221; victims of sexual exploitation&#8212; is not, by necessity, a force that silences those who receive compassion. While on certain contexts resort to compassion may indeed be disempowering, in other contexts political mobilization led by compassion may produce social emancipation. The essay thus suggests that the resort to compassion be gauged in every single case through a pragmatic analysis of the costs and benefits of the use of compassion. This framework is rehearsed in the second part of the essay through an analysis of the constitutional debate on prostitution and sex work in Colombia. Here, the article shows how this debate transpires in a field dominated by a compassionate sexual humanitarianism leading to the &#8220;sentimentalization&#8221; of dignity, autonomy, and equality. A pragmatic analysis of the doctrine of the Colombian Constitutional Court on prostitution, sex work and human trafficking allows to provisionally conclude that this sentimentalization simultaneously supports the political projects of abolishing prostitution and regulating sex work.]]></p></abstract>
