</abstract>
<abstract abstract-type="short" xml:lang="en">
Abstract: This article examines the challenges faced by the intellectual property system in light of new forms of creation arising from the digital revolution and artificial intelligence. The first section analyzes emblematic cases of content creation on social media -such as posts, reels, memes, viral challenge compilations, and collaborative works- which challenge traditional copyright concepts of originality, authorship, and individual creation. It also addresses the phenomenon of digital plagiarism and the mass use of copyrighted works, focusing on notice-and-takedown mechanisms and automated rights management systems implemented by digital platforms. The second section explores specific challenges posed by artificial intelligence, including the generation of synthetic works, web scraping practices, prompts as potentially creative elements, and the unauthorized imitation of artistic styles. Particular attention is given to the DABUS case, which has sparked international debate over whether an AI system can be recognized as an inventor under patent law. The article concludes that the current legal framework is insufficient to address the complexities of contemporary creative practices and highlights the need to rethink the foundations of copyright and patent law. The aim of this work is to contribute to a critical reflection on how to balance protection, access, and value creation in the evolving digital landscape.
</abstract>
