MARQUEZ-CASTILLO, Rosa Magdalena; MONJARDIN-BOURGUETE, Vitelio Antonio; RAMIREZ-CEBALLOS, José Antonio  y  HINOJOSA-NUNEZ, Félix Fernando. Perception of the anesthesiologist's commissions medical arbitration, the legal medical problem and their professional performance. Anest. Méx. [online]. 2017, vol.29, n.3, pp.33-41. ISSN 2448-8771.

Biotechnological advances have given rise to greater demands of society, regarding life expectancy and expectation of cure, conditioning dissatisfaction with health services and increasing demands 1. The creation of medical arbitration commissions, as an alternative means of conflict resolution, shows the reasons for nonconformity in medical, surgical and childbirth care among others 6. Objective: To search the relationship between alterations in medical practice, adverse events, medical legal problems and professional experience.

Methodology.

A descriptive cross-sectional study (survey) was designed to analyze four groups of variables. 1. Data from origin and professional experience. 2. Knowledge of the operation of medical arbitration commissions in the country. 3. Legal medical event and repercussions on medical practice and 4. Occurrence of adverse events and their registration. With 131 professionals belonging to the Mexican Federation of Anesthesiology Colleges.

Results:

Regarding the question: Do you know an anesthesiologist with any legal medical problem?, 70.4% answered yes. The legal medical problem was solved by the criminal, 41%. Do you know the functioning of the legal commissions?, 54% answered yes. Was the legal medical problem related to an associated adverse event? 50% was affirmative. The most involved institution in these legal problems was the Mexican Institute of Social Security with 37.8%.

Conclusion:

The incidence of complications in medical practice increases morbidity and mortality attributed directly or indirectly to anesthetic practice. Defensive medicine affects the performance of anesthesiology professionals. It is imperative to improve patient safety protocols and medical training to the personnel involved.
