This work revisits stipulations in the Spanish legislation and in the Indian rights over what should be the function of the jail during the Viceregal period in which it was established that this building should be used for the custody of the offender while his legal situation was resolved - reason for which it should be kept in optimum condition. Revision of the files of the criminal branch of the Archivo de la Real Audiencia de Guadalajara and the Archivo General de la Nación clarify the understanding of the distance which existed between what was established in the legislation and what happened in the spaces under the jurisdiction of the Intendencia de Guadalajara.
