The degradation of the environment and the defense of the environment are two situations that can endanger the integrity of people. Two situations that can force a person to leave the place where they reside in order to find a safe place. But, can a person request refuge for these two situations? The answer to this question focuses the development of this paper, therefore, from a legal point of view and from the comparative analysis of both situations related to the environment, on the one hand, the main existing obstacles to recognizing refugee status in these two areas are analyzed here and, on the other hand, the possibilities, alternatives and changes that can be built from the interpretation of the asylum and refugee regulation are developed, taking as generic reference national and international standards in force in Colombia, Spain, Mexico and Chile.
