In the present study of comparative law, an overview is offered regarding Italian legislation regarding the figure of the crime of persecutory acts or, as also defined in the doctrine of that country, “stalking”. For the purpose of being as complete as possible, this work exposes the characteristics of the crime, from its objective and subjective aspects, including the protected legal good, the behaviors that it sanctions, how they should be deployed, the intent required for such purposes and the penalty planned for the crime. In the same way, procedural issues are addressed that make this crime of interest and in a complementary way, profuse jurisprudence has been analyzed in this regard, in order to assess its compliance in judicial practice.
