This essay seeks to look at outsourcing in Venezuela, aims to analyze the outsourcing in the Venezuelan legal context, for which it is necessary to first identify when we are in the presence of a work contract and differentiate it from other contracts provision of services civil and commercial; second to establish when there is simulation or fraud, that is to say when there is outsourcing and finally to examine the triangular relations of work. To achieve the proposed objectives, a documentary and descriptive level research was carried out, with emphasis on the legal regulations that regulate the subject. It is concluded that the phenomenon of outsourcing under the terms of labor legislation always implies the precariousness of employment, because who seeks to evade compliance with labor obligations generates the loss of labor rights for the workers involved. It is therefore of utmost importance to achieve social justice, that the state search to eliminate the emptiness and vagueness in the legal normative that regulates this matter in order to facilitate the interpretative work of judges in matter of outsourcing and thus contribute to there is no evasion of labor obligations and therefore guarantee the legal protection of outsourced workers.
