In this era of globalization, the law has generated legal systems, especially foreign trade, developing supra-national standards with the idea of resolving disputes that arise in the activities of transnational corporations, prevailing rules necessary for a global economy.

Faced with this internationalization of law, this article aims to reflect on the extraterritoriality of mercantile procedural law, which through the analytical method we expose the transcendence of the mercantile law, seeking the recognition of its application at a global level, through a discussion of those who make. the measure as an anastate norm but applicable in all countries and those that reject it because it is not an official norm of the organs of the State, pretending to generate the idea of an international trade code, and an international tribunal that applies it.
