Abstract

Nowadays we presence two pathologies that afflict democracy: the political control of information and the private control of information. In Venezuela both controls are exercised by the State and by the media. From this premise, the recent venezuelan communicational reality it's analyzed, through the theoretical constructions of governmental communication hegemony and freedom of expression. The latter is taken from its development in the Inter-American System of Human Rights Protection. As regards of the construction of freedom of expression by the Inter-American Court of Human Rights (IACHR), from its very first decision in this topic, it recognized that this liberty "it's an angular stone in the very existence of a democratic society", and that it has an individual and a social dimension; that's why the State not only has an obligation on minimizing its restrictions, but also on strengthen the informative pluralism. These standards can be applied to the Radio Caracas Televisión (RCTV) case, recently decided by the IACHR, which will be analyzed using the pluralism and freedom of expression juridical discourse, as well as the communicational hegemony political discourse, in the venezuelan context, where the State, instead of designing public policies aiming a better standard of protection and strengthen informative pluralism effectively, acts otherwise. The proposal is to create and consolidate adequate guarantees for the public and private media to become instruments of social emancipation, and not of domination.
