This work contributes to the area of criminal law in order to understand the limits of the crime of fraud based on the doctrinal currents that are developed by the law in its literature in relation to crimes against the economic patrimony of the people who are seen compromised by this harmful and criminal action. An analysis of the constituent elements of the crime of fraud was developed, which in our legislation is contained in article 186 of the Comprehensive Organic Criminal Code. The active and passive subjects in the execution of the crime are established, considering the typology of the fraud, its dogmatic and axiological structure.
