Abstract

This text intends to provide a series of concepts, ideas and reflections that allow to understand the crucial role that the recent right to freedom of discrimination in the Mexican legal system plays in the construction of a democratic system which is inclusive and of quality. In line with the debate about democracy and in the horizon of citizenship rights, it offers an approach to the complex and diverse nature of this particular form of disparity of treatment, dominium and social exclusion, based on prejudices and social stigmas, this is, in pre-established ideas, stereotypes and social parameters that assign different places to individuals and social groups in the social board according to certain characteristics or identity features. It is noticed that the discriminatory practices are harmful to the society because they have as a consequence the denial and/or limitation of the exercise of the human rights and the opportunities of the individuals that suffer them.

As well, this document outlines some challenges to the public agenda in general, and to the different institutional and citizen’s agendas in particular, including the academic agenda, arising from the discrimination as a structural phenomenon of sociocultural and political character, in order to contribute to the constitution of a scientific rationality and an anti-discrimination State policy.
