Resumen

MENDIZABAL BERMUDEZ, Gabriela. Comparative law study of labor inspection in Latin America. Rev. latinoam. derecho soc [online]. 2019, n.28, pp.157-190. ISSN 2448-7899.  https://doi.org/10.22201/iij.24487899e.2019.28.13147.

The labor inspection over decades has contributed as a means to ensure the rights of workers against the employer.

It is the authority responsible for enforcing labor and social security regulations, as well as the authority to issue the corresponding sanctions in case of violation of the labor regulatory framework.

While it is true that the competence and powers of labor inspection varies in each of the countries, nevertheless there are multiple similarities such as the sanctioning power, control, counseling among others.

In this context, this article is a comparative analysis of labor inspection as the authority that contributes to the enforcement of workers’ rights through the Comparative Law study of 5 countries in Latin America, which present some socio-demographic and legal similarities, allowing a comparison between them for the elaboration of this work, verifying the hypothesis that the labor inspection is an externalization mechanism of labor law and Social Security Law.

Palabras llave : Externalization; labour inspection; social security; labor rights; worker.
