Currently, Spanish Labor legislation has gone through constant and accelerated reform, causing a certain flexibility that affects labor relations. In addition, the Constitutional Court as well as the Superior Court have published diverse interpretations in this matter. The present article will analyze how the exercise of determined fundamental rights within a business has become distorted, especially the right to communications secrets contemplated in article 18.3 of the 1978 Spanish Constitution; limiting tutelage and guaranteeing a worker's citizenship rights.
