This article will deal with the situation in which it is alleged that the recognition and enforcement of the foreign arbitral award should be denied on the basis of the arbitrator’s lack of impartiality. The first step will be understanding what scholars and case law consider to be the lack of impartiality of the arbitrator. Next, it will be verified whether the arbitrator’s lack of impartiality leads to the denial of recognition and enforcement of the foreign arbitral award. The ground for denial will be discussed, based on the analysis of the New York Convention of 1958. The presentation of the position of foreign and especially Brazilian case law on the subject will be important to reach conclusions regarding the possibility, if that is the case, to deny and to try to identify the parameters used in denial decisions.
