The Inter-American Court of Human Rights (IACHR) changes over time. In the 1980s, the main cases were submitted to Advisory Opinion that moves towards a more Decisions and judgements in a interventional way at the Court Caselaw in 90´s. Judicature and the Presidency of Pedro Nikken allows a company to have the freedom of decision during the period, as their own laws while preparing for justice. The historical context of the rise of human rights and an idea of progressive development is the most qualified background of the proposal of “Court Nikken” that critically analyzes the expansion of the contentious jurisdiction IACHR. The advisory companies and contentious cases judged by the IACHR have demonstrated stages of development and formation of the Court’s own identity.
