This paper analyzes the relationships between the transnational legal plane and national and international rights, with special emphasis on the regulation of the hydrocarbon sector with the aim of understanding the transformations of the emergence of transnational law and the challenges involved in socialization and the democracy of the production of the right and the inequality between the different subjects that participate. It consists of three parts: the first analyzes the “denationalization” of transnational law and its effects; the second, the “materialization” and its effect on the public / private distinction; the last one, the challenges of transnational law in terms of socialization, democracy and equity. The central hypothesis is that the processes of “denationalization” of regulation in the energy sector tends to produce a new logic in the production of law both nationally and globally, erasing the distinction between public and private.
