PENICHE LUNA, César Andrés. The Interpretation of the Concept of Exclusive Economic Zone in Mexican Criminal Law. Anu. Mex. Der. Inter [online]. 2019, vol.19, pp.179-210. Epub 11-Mayo-2020. ISSN 1870-4654. https://doi.org/10.22201/iij.24487872e.2019.19.13322.
The exclusive economic zone was envisaged, under international law, as a maritime area that aimed to preserve the natural resources therein for the coastal State. This idea was codified in the United Nations Convention for the Law of the Sea and respected in the 1988 United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances. Notwithstanding, coastal States have tried to amplify the jurisdiction they possess over the EEZ to other activities, such as the prosecution of drug trafficking crimes. In Mexico, two recent judgments issued by the Nation's Supreme Court of Justice have aimed at such objective. The criteria contained therein, in the light of the relevant provisions of UNCLOS and the 1988 Convention, are manifestly unfounded and must be reverted to advert international responsibility.
