The consequences of the granting of amnesties place these at the centre of the apparent debate between peace and justice that occurs in virtually any effort to end a conflict using means other than absolute victory, evasive in itself. This is consequence of the supposed abandonment in which victims of serious human rights violations fall when it is decided not to act against those responsible. This paper supports the argument that in a diversity of situations, amnesties are decidedly useful tools to achieve the resolution of conflicts that, due to their duration or seriousness, involve serious violations of human rights. The above, particularly considering the situation experienced in Mexico for more than ten years and the proposals arising from the political sphere on the granting of an amnesty. Hence, using as means the analysis of the situation experienced in Cambodia since 1970 and the tools used in the 1990s in an attempt to put an end to it, the paper illustrates what limits and minimum considerations an amnesty should keep regarding International Law, to be considered as a valid and lawful instrument in the field of transitional justice.
