Abstract

This article aims at bringing elements of answer in order to answer whether the American Declaration on the rights of indigenous peoples adopted on June 14th 2016 has an added value regarding the link between indigenous peoples’ rights and environmental protection and the integration of this link within the OAS. The author identifies the potential of the Declaration regarding the inter-American system’s fragmentation in terms of legal grounds and instruments, while the Declaration’s potential is very limited in terms of adjudicative authorities.
