Abstract

This article examines the international abduction of children and teenagers, which consists on the wrongfully removal or retention of children from their habitual environment, usually by one of the parents, without the consent of the natural or legal person lawfully exercising the right of custody. The main aspects of The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction will be assessed in the light of the Brazilian legal framework as applied in a real situation -the Sean Goldman case- that had great repercussion in Brazil because of its particularities, which resulted in an judicial dispute between the American father and the Brazilian family of the child, that ultimately resulted on the prompt return of the child to the United States.
