ESTUPINAN-SILVA, Rosmerlin. Indigenous and Tribal Peoples: the Construction of Inherent Cultural Contents in the Inter-American Case Law of Human Rights. Anu. Mex. Der. Inter [online]. 2014, vol.14, pp.581-616. ISSN 1870-4654.
The Inter-American judge has found that a conventional right, devoid of a cultural analysis, would be an illusory right for millions inhabitants of the American continent. In this research paper we argue that, using a method of universal interpretation, the Inter-American judge has largely developed the content of the conventional rights through interpretation methods and precise tools, including the theory of the inherent contents, that is in the process of construction and has been applied ratione personae and ratione materiae.
