During the first decade of 2000 a group of Sahrawi has obtained the status of stateless in Spain. To be able to solve this issue the Spanish courts have been forced to check again a wavering question, since the abandon of Western Sahara by Spain in 1975 and the situation of international vulnerability in which the native population remained. We consider whether the Spanish courts have tried to solve legally a problem of political nature, and in what measure the concession from the stateless status to the Sahrawi has modified the official or majority version of what happened with the Western Sahara. Beyond the interest of the concrete case, we understand that the arguments, problems and questions generated by the status of the Sahrawi in Spain can be extrapolated to other groups in similar situations.
