Abstract

The present article gives us in its first part, a sample of the evolution of the Communitarian Law regarding the immigration issue and how it developed from being a minor topic to a frontline one within the European legislation. In its second part, the author refers specifically to the expulsion of non-communitarian nationals who are illegally in the territory of the European Union. The author shows us that the directives of the European Parliament and Council breach the rights of access to justice and freedom. In the last section, she lets us examine how the communitarian norms have had -in certain occasions- an undue primacy over international ones.
