Of ninety nine contentious cases that the Inter-American Court of Human Rights has known until May, 2008, only in two it has not begun to know the heart of the matter for having been admitted at least one of the preliminary exceptions made for the sued State. For it, from the analysis of the Case Alfonso Martín del Campo Dodd and the Mexican experience, in the article tries to give a response to what one can and it is not possible to do after a judgment of this type, to assure the protection of the fundamental rights, without affecting the juridical safety and procedural equity that must guarantee any system ofprotection in the step of individual requests.
