This work addresses the Constitutional Amendment number 54 from September 20th, 2007. This amendment re-established the recognition of the original Brazilian nationality in our Legal System, by registry on the Brazilian Consulate and Embassy in other countries, of Brazilian child born outside of Brazil. This recognition and the criteria for its concession as admitted by International Law are analyzed in this paper. Additionally the non-nationality as considered in the latest changes done to the Constitution; this allows the change of the situation of thousands of children reclaiming their cittzenship.
