The author establishes that in the sentence of preliminary exceptions of the case Las Palmeras vs. Colombia, the Interamerican Court of Human Rights decided in accordance to the principle of attribution of competences. This way it proclaims itself incompetent to declare the responsibility of a State part of the American Convention on Human Rights for violating norms and principles of the humanitarian international law. Even if in the subsequent resolutions a change in the jurisprudence has not been manifested, in practice, it has been develop tng trough the systematic interpretation of different international instruments such as the American Convention of Human Rights, Protocol II of the Geneva Conventions 1977, Viena Convention on the Law of Treaties and a couple of clauses included in the American Convention.
