Objective: from the perspective of the service users of health and justice public institutions, the analysis made in this article is focused on the disadvantages that prevent citizens for claiming their health and justice rights, as well as the resources to enforce those rights. Methodology: qualitative research based on case studies, carried out in Mexico City, Guanajuato, and Yucatán. Results: when claiming their rights, service users are isolated, they do not fully understand the health or justice institution, they are in a vulnerable condition, and yet they depend on them. Some of the resources to overcome this situation are money and time, acquiring specialized knowledge, having the support of an expert, and having the motivation to confront the institution. Value: understanding the gap between rights on paper and rights in practice, from the service users’ point of view. Limitations: this study does not consider the position of institutions. Conclusions: claiming health and justice rights in Mexico is a process that citizens undertake while they are in a vulnerable condition, and it depends on their own efforts and resources.
