This article tries to help to explain the differences in the quality of the rule of law between Mexico and Chile beginning with its institutional evolution along the 90s and 2000 decades. Analyzing the sequence, the context and the strategies of the institutional change, it shows that while in Chile the judicial reforms was privileged over the electoral ones, in Mexico happened the contrary. The study suggest that a sequence of institutional change that during the transition and the firsts democratic governments put the accent in the electoral reforms over the those related with the rule of law, in the long run results unfavorable to the quality of the latest.
