The present article aims to highlight the legal criteria for the sentences handed down by the Federal Court of Administrative Justice, from 2014-19, in contentious administrative proceedings relating to migration and refu-gees. It will present an in-depth examination of the main contributions/repercussions of the sentences handed down, in light of the 2011 constitutional reform and the criteria upheld by the Federal Court of Administrative Justice, in resolved migration cases where the responsible authority was the National Institute of Migration. Finally, the present paper highlights the extent and limits of the Federal Court of Administrative Justice in protecting the fundamental rights of migrants.
