On 18 th June 2008, the Mexican criminal justice system was reformed, via constitutional decree, entering fully into force in 2016 and representing a transition from a mixed-inquisitive to a mixed-adversarial model. It is based on support for due process guarantees/guaranteeism, which aims to ensure compliance with the principals and rights enshrined in both the constitution and applicable international treaties. The present study seeks to analyse the comprehensive reparation, to which the victim is entitled as part of their fundamental rights, of damage resulting from the crime and its corresponding penal enforcement. To this end, this study examines the public policy and mechanisms designed by the State to guarantee compliance and efficacy, in terms not only of the subject committing crime, but also the State itself, dealing with such specific cases as homicide, sexual crimes, people trafficking, kidnapping and victims pertaining to vulnerable groups. This analysis will be undertaken via the systematic interpretation of the norms in this area, the corresponding jurisprudence and the study of cases that have set precedent in our nation.
